A woman has received compensation of more than 230,000 euros following a fall she suffered in a nightclub, which caused a fractured hip.
Carmel Duddy sued the Allingham Arms Hotel in Bundoran, Ireland, over the incident, which happened on February 26, 2017.
The 59-year-old woman was in the company of a cousin when she suffered the fall, caused by spilling several drinks on the dance floor.
As she explained in her lawsuit, several waiters were seen crossing the dance floor with drinks to deliver to customers. The spilled liquid made the dance floor slippery and was the cause of the woman's fall, reports the Irish Times.
The hotel defended itself by claiming that it had an inspection and cleaning system in place, but the judge ruled that there was “no credible evidence” that any proper system for managing the known risks was in place on the night of the accident.
Carmel Duddy, who was working in a hospital at the time, says the injury she suffered left her unable to work
A medical report concluded that she was likely to have ongoing chronic pain and discomfort and the judge accepted that her age and education meant that she had no other employment opportunities after her cleaning job ended.
Having classified the injury and consequences as “moderately serious”, the judge awarded 55,000 euros in general damages, plus 178,486 euros for loss of earnings up to the age of 66.
