Prosecutors seek second mental evaluation for father accused of running over and k*lling a random Ohio deputy after police sh*t his son in a carjacking incident the day before.
A court-appointed psychologist determined that Rodney Hinton Jr., 38, suffers from a serious mental illness.
This could disqualify him from facing the death penalty. Both sides will return to court Friday to select a second doctor for another evaluation.
Hinton faces aggravated m*rder, m*rder, and felonious assault charges in the May 2 k*lling of Deputy Larry Henderson. Under Ohio law, if he is found to have been seriously mentally ill at the time of the crime, the death penalty cannot be imposed.
Prosecutors say he purposely drove a vehicle into the 33-year veteran of the Hamilton County Sheriff’s Office. Deputy Henderson was also a U.S. Marine, husband, father, grandfather, and foster parent.
