Apple Will Get Help to Comply with Digital Markets Act Obligations

The European Commission has today opened two procedures to help Apple comply with interoperability obligations under the Digital Markets Act (DMA), detailing some of the measures that the gatekeeper must take.

In the first procedure, the EU executive wants to specify how Apple will provide effective interoperability in the iOS operating system, with features such as notifications, device pairing and connectivity, focusing on iOS connectivity features and functionalities that are predominantly used for and by connected devices, such as smartwatches and headphones.

In the second procedure, Brussels is examining the system that Apple has set up to respond to interoperability requests from developers and third parties for iOS and iPadOS.

The procedures must be concluded within six months of their opening and the Commission will communicate its preliminary findings to Apple, explaining the measures that the gatekeeper must take to effectively comply with the DMA’s interoperability obligation.

On September 6, 2023, the European Commission designated Apple as the access controller under the DMA in relation to iOS, the App Store and the Safari search engine.
